First of all, is the breaker bad? How did you test it? Breakers don't usually go bad, very seldom. A simple test is to use a meter and check for voltage at the output terminal. Is it tripping or what is going on? Unhook the wire feeding off the breaker, then reset it. If it holds, it's probably fine. You can use an ohm meter and check for 0 ohms through the breaker too (with it unhooked and out of panel)

I have a 40 amp gfi circuit breaker for my hot tub and want to know how to test it to ensure that it is not the breaker that is faulty as they are very expensive and from my understanding they cannot be returned for a refund after purchase
