Android Ice Cream Sandwich (ICS) is version 4.0. Versions 4.1 through 4.3 are known as Jelly Bean.
If your device says it has Android 4.1 then you already have Jelly Bean and you are all set! If it says 4.0 then you currently have ICS. Without knowing which device you are using it's impossible to know whether or not your device supports Jelly Bean (assuming you currently have 4.0).
If an update is available most phones and tablets will eventually get the update automatically provided that they are activated on a network or by wifi. Not all manufacturers update all devices and some devices get "left behind" due to hardware limitations.
If you can provide the manufacturer (ie LG, Samsung, HTC) and the model name of the device with your question that will help to determine what version of Android it is capable of running.
I've I same issue, wanting to upgrade to jelly bean, as my cell was supposed to have arrived with, but can't seem to get the update. Naturally, I don't know what cell the initial poster has, but I have a Pantech Perception, purchased via saveontracfone. Any ideas?
Having accidentally posted before I wanted, I did find an app on Google Play store that will at least tell you if your device is capable of accepting the update you seek. It's called "Update for Android Pro."
