I'm surprised that you would refer to your husband as "it". To get rid of "it", I would contact a divorce lawyer. Seriously, here's some advice from another web site. I've provided the link to it as they have info on keeping spyware off of your phone. Hopefully there's nothing on the phone that he would be offended by. Good luck!
If you believe that your cell phone is already infected with spyware, remove the battery immediately. Then, take your phone to a local cell phone store. The support staff at the store should be able to remove the spyware from your phone. If they cannot, you may need to send your phone in to the manufacturer for repairs.
I doubt that you have spyware issue but with my blackberry when it freezes up and does other strange things, I simply remove the battery and then wait about 20 seconds and palce it back in. You can also update your blackberry software.
