Turns on OK but the pointer fails to appear and when it does appear it seems to stick in different areas. Once it finally works to bring up a sport it works fine. a notice comes up to check batteries. I put three sets of new batteries in without results

Make sure you are either using high quality alkaline batteries or rechargeable Nickel Metal Hydride (NiMH) batteries. This is what Nintendo advise in the battery article linked below.
